„Stop CETA!“ in Bayern wollen sich die Initiatoren noch nicht
geschlagen geben.

Bayerische Verfassungsgerichtshof
hat heute das Volksbegehren „Stop CETA!” für unzulässig
erklärt. Die Begründung
lautet unter anderem, dass bisher noch kein Verfahren der
Bundesgesetzgebung
eingeleitet sei und absehbar auch nicht eingeleitet werden
solle. „Wir
verstehen das Urteil so, dass unser Volksbegehren
möglicherweise zulässig ist,
wenn ein Bundesgesetz für CETA bereits auf den Weg ist – in
diesem Fall wären
wir schlicht zu früh dran gewesen“, sagt Socher. „Wir werden
das jedenfalls
gründlich prüfen und alle Möglichkeiten ausschöpfen, um CETA
im Bundesrat zu

Verfassungsgerichtshofs stützt sich auf folgende Erwägungen:<br>

landesgesetzliche Weisung gegenüber der Staatsregierung für
das Abstimmungsverhalten
im Bundesrat mit dem Grundgesetz vereinbar wäre, erscheint
zweifelhaft, bedarf
aber keiner abschließenden Erörterung.<br>

Abstimmung im Bundesrat ein Gesetzesvorhaben betrifft, das
ausdrücklich auf die
Übertragung von Hoheitsrechten auf die Europäische Union durch
ein Gesetz nach
Art. 23 Abs. 1 Satz 2 Grundgesetz gerichtet ist. Maßgeblich
ist dabei allein,
wie die Gesetzgebungsorgane des Bundes das zur Abstimmung
gestellte
Gesetzesvorhaben bewerten.<br>

Bundesgesetzes, das nach Art. 23
Abs. 1 Satz 2 Grundgesetz der Zustimmung des Bundesrats
bedarf, weder
eingeleitet noch steht eine solche Einleitung unmittelbar
