Der Verein kritisiert die Begründung des Senats, der Volksentscheid sei rechtlich nicht umsetzbar, obwohl die Zulässigkeitsprüfung im Vorfeld des Volksbegehrens ein anderes Ergebnis gebracht hätte. <o:p></o:p></span></p><p class=MsoNormal><span lang=DE style='font-size:11.0pt'><o:p> </o:p></span></p><p class=MsoNormal><span lang=DE style='font-size:11.0pt'>„Volksbegehren müssen nach Einreichung der erforderlichen Unterschriften eingehend auf ihre rechtliche Umsetzbarkeit geprüft werden. Das ist anscheinend nicht ausreichend geschehen“, sagt Oliver Wiedmann, Vorstandssprecher des Vereins Mehr Demokratie Berlin-Brandenburg. „Hätte der Senat das Volksbegehren im Vorfeld für unzulässig erklärt, so würde die Umsetzbarkeit gerichtlich geprüft werden. Unklarheiten über die rechtliche Umsetzbarkeit führen nun zu Verunsicherungen unter den Abstimmenden“, so Wiedmann weiter. <o:p></o:p></span></p><p class=MsoNormal><span lang=DE style='font-size:11.0pt'><o:p> </o:p></span></p><p class=MsoNormal><span lang=DE style='font-size:11.0pt'>Volksbegehren und Volksentscheide sind klar in der Verfassung von Berlin geregelt. Ein zentraler Bestandteil ist die präventive Normenkontrolle durch den Senat nach Einreichung des Volksbegehrensantrags.
